The TGA has recently announced changes around the advertising of some Schedule 4 medicines.
Terms such as “anti-wrinkle”, “wrinkle relaxers” and “dermal fillers” now cannot be used when advertising non-surgical procedures.
In a release on behalf of the TGA it stated that “the promotion of a health service as a means to obtain a prescription medicine is a form of advertising prescription medicines. Decisions about treatments that involve the use of prescription medicines should be made by a doctor in consultation with each individual patient. It is not legal to influence consumers about the use or supply of prescription medicines through advertising”.
It is understood the TGA will publish revised guidance by late January 2024 and that one of its compliance priorities for 2024 is to detect and change unlawful advertising.
